“Saat itu sebelum kejadian petugas kepolisian kan sudah tahu kalau ada dua kubu yang setuju dan tidak setuju terkait dengan aksi penambangan pasir ilegal. Kubu yang setuju penambangan adalah Kepala Desa Selok Awar-awar dan kubu yang tidak setuju adalah Tosan dan kawan-kawan,” katanya di Pengadilan Negeri Surabaya seperti dikutip antara, Kamis (17/3).
Dalam persidangan dengan agenda mendengar keterangan saksi dari mantan Babinkantibmas Polres Lumajang, Sigit Pramono, terbukti jika saksi baru mengetahui kejadian penganiayaan setelah kejadian berlangsung.
“Dulu waktu kami menjadi aktivis, anggota polisi akan mendatangi kami jika kami akan melaksanakan demo supaya aksi yang dilakukan saat demo tidak bertindak anarkis. Lha ini sudah jelas-jelas ada dua kubu yang berseteru dan mengancam akan terjadi pembunuhan kok malah dibiarkan. Ini kan aneh,” ujarnya.
Sementara itu, dari keterangan saksi Sigit mengatakan jika dirinya tidak mengetahui kalau lokasi penambangan pasir di desa Selok Awar-awar tersebut merupakan tindakan ilegal, karena dirinya hanya tahu kalau penambangan tersebut digunakan sebagai desa wisata.
“Saya selama sebelas bulan bekerja di tempat tersebut tidak mengetahui kalau ada penambangan pasir ilegal karena saya tahunya hanya untuk pengembangan wisata desa, bukan sebagai penambangan pasir ilegal,” katanya.
Beberapa kali hakim menanyakan kepada saksi tentang fungsi dan tugas polisi kalau mengetahui adanya rencana demo, saksi mengatakan kalau akan dilakukan tindakan persuasif untuk meredam amarah masyarakat.
“Kalau ada demo ya harus dilakukan langkah persuasi terlebih dahulu supaya kedua belah pihak yang akan demo bisa diredam amarahnya,” katanya.
Kasus pembunuhan Salim Kancil dan penganiayaan Tosan terjadi pada 26 September 2015, dua warga Desa Selok Awar-awar itu menjadi korban penyiksaan lebih dari 30 orang mendukung penambangan pasir liar di Pantai Watu Pecak atau anak buah Kepala Desa Selok Awar-awar.
